1. Scope
These terms govern the sale of goods through this website by El Khabya ("we", "us"). By placing an order you accept these terms. Full company details are on our Impressum.
2. Products
We sell food products: honey, olive oil, and related Tunisian goods. As natural products, colour, texture, and crystallisation vary between batches and over time. Such variation is normal and not a defect. We describe our products by origin and character and make no health or medical claims.
3. Orders and contract
Your order is an offer to buy. The contract is formed when we confirm dispatch by email. We may decline an order, for example where stock is unavailable or an obvious pricing error has occurred.
4. Prices and payment
Prices are shown in euro and include applicable VAT unless stated otherwise. Shipping is added at checkout. Payment is taken through our payment processor at the time of order.
5. Delivery
Delivery times and costs are set out in our Shipping Policy. Estimated times are not guaranteed. Risk passes to you on delivery, or to a consumer in line with applicable consumer law.
6. Returns and withdrawal
As sealed, perishable food, our products are generally exempt from the standard right of withdrawal once delivered. Your rights where goods arrive damaged or incorrect, and your statutory rights, are set out in our Returns & Refund Policy.
7. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For ordinary negligence we are liable only for breach of a material contractual duty, limited to foreseeable, typical loss. Mandatory liability, including under product-liability law, is unaffected.
8. Allergens
Products may contain or have contact with bee products and other natural ingredients. Allergen information is shown on each product page and label. If you have an allergy, check before consuming.
9. Intellectual property
The El Khabya name, logo, the arch mark, text, and imagery on this site are our property and may not be used without written permission.
10. Governing law
These terms are governed by the law of the Federal Republic of Germany, without prejudice to mandatory consumer-protection rules of your country of residence. Place of jurisdiction is Berlin, where permitted.
11. Dispute resolution
The EU online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to and do not currently participate in arbitration before a consumer arbitration board.
